Terms and Conditions

§ 1 Scope and Provider

These General Terms and Conditions (GTC) govern the use of the AuPairMatch platform (hereinafter “Platform”), reachable at aupairmatch.app, operated by Anna Marie International Sales Company GmbH, Willdenowstraße 19, 13353 Berlin (hereinafter “we” or “AuPairMatch”). By registering you acknowledge these GTC as binding.

§ 2 Subject Matter and Role of the Platform

AuPairMatch is an online matching platform that connects au pairs and host families and provides them with profiles, matching, messaging, video calls and visa information.

AuPairMatch is not an employment agency, not an au pair agency and not an employer and is not a contracting party to any au pair arrangement. The formation, content and execution of an au pair stay are solely the responsibility of the participating users. No success in matching is guaranteed.

§ 3 Eligibility to Use

  • You must be at least 18 years old and fully capable of contracting to create an account.
  • Only one account per person is allowed; use is in your own name.
  • You guarantee that your information is true, current and complete.
  • Use is prohibited if you have previously been excluded or violate applicable law.

§ 4 Registration and Account

Registration is required to use the service. You keep your login details confidential, report misuse immediately and are responsible for all activity on your account.

§ 5 Code of Conduct

A respectful, honest and safe interaction is the foundation of our community. You commit to:

  • Be honest: real identity, real photos, truthful information.
  • Be respectful: no harassment, discrimination, hate speech, threats or bullying.
  • Protect children: content or behavior that endangers, exploits or sexualizes minors is strictly prohibited and will be reported to authorities.
  • Stay safe: share sensitive data only after trust is built; use the platform for the initial contact.
  • No misuse: no spam, advertising, money requests or recruiting for other services.

§ 6 Prohibited Activities

The following are expressly forbidden:

  • False, misleading or fraudulent information and identity impersonation (fake profiles);
  • Harassment, threats, stalking, hate speech or discrimination (e.g., based on origin, gender, religion or sexual orientation);
  • Sexually offensive content, nudity and any sexual contact attempts – especially with or through minors;
  • Requesting, collecting or sending money or financial data of other users (scam, “romance scam”, advance‑fee fraud);
  • Spam, mass messages, advertising, pyramid schemes or poaching for competing services;
  • Uploading illegal, violent, defamatory or copyright‑infringing material;
  • Bypassing security or moderation features, scraping, automated data extraction or bots;
  • Using the platform for illegal purposes, human trafficking, exploitation or undeclared work.

§ 7 User Content

You remain responsible for the content you upload (profile, photos, messages) and warrant that you have the necessary rights. You grant us a simple, revocable right to store this content for operating the platform and to display it to authorized users. Content that violates these GTC or applicable law may be removed by us.

§ 8 Safety and Reporting

We provide tools to report and block users as well as moderation. Please report suspicious behavior. Despite our safeguards we cannot guarantee the identity, reliability or intentions of other users. Take usual precautions when meeting in person.

§ 9 Moderation, Suspension and Exclusion

For violations we may remove content, restrict features or suspend accounts temporarily or permanently. We will inform you of significant actions and, as required by the Digital Services Act (DSA), give you the opportunity to complain or appeal.

§ 10 Services and Prices

Basic use is free during the current startup phase. Paid services are clearly marked before contract formation; the prices shown at the time of booking and the conditions displayed in the order process (duration, renewal, cancellation) apply.

§ 11 Right of Withdrawal for Consumers

If you, as a consumer, conclude a paid contract, you have a statutory 14‑day right of withdrawal. The full withdrawal notice and the model withdrawal form are provided to you during the order process and after contract formation in text form. For digital content/services the right of withdrawal may expire early if you expressly consent to immediate execution and acknowledge its loss.

§ 12 Term and Termination

You may delete your account at any time. Paid subscriptions end at the expiry of the booked term unless otherwise agreed. The right to extraordinary termination for important reasons remains unaffected.

§ 13 Liability

We are fully liable for intent and gross negligence as well as for damages resulting from injury to life, body or health. For simple negligence we are liable only for breach of essential contractual obligations (cardinal duties) and limited to the typical, foreseeable damage. We assume no liability for the behavior of other users or for the formation, content and execution of au pair arrangements. Further liability is excluded.

§ 14 Data Protection

Processing of personal data is governed by our privacy policy.

§ 15 Changes to These GTC

We may amend these GTC with future effect if a compelling reason exists (e.g., legal changes or functional updates). We will inform you of changes in text form in a timely manner. If you do not object within the specified period, the amended GTC are deemed accepted; we will point this out separately.

§ 16 Final Provisions

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods; mandatory consumer protection laws of your country of residence remain unaffected. The court of jurisdiction is Berlin, provided you are a merchant or have no general jurisdiction in Germany. The European Commission provides an online dispute‑resolution platform: https://ec.europa.eu/consumers/odr/. If individual provisions are invalid, the validity of the remaining provisions remains unaffected.
